Amber Valley Borough Council bags fine for serial fly tipper
Amber Valley Borough Council has secured a successful prosecution against a fly-tipper who was convicted of the same offence six years ago.
Christopher Curzon-Pollard, of Huthwaite, Nottinghamshire, was convicted at Derby Magistrates Court on October 17 after admitting to fly-tipping a sofa, carpet, packaging and other household waste in Stoney Lane, Langley Mill, on May 9, 2021.
The charge of ‘failing in his duty of care as an occupier of domestic property to dispose of waste in an appropriate manner’ mirrored a sentence handed down to him in October 2016 for a similar offence.
Mr Curzon-Pollard entered a guilty plea and was fined £250, ordered to pay a Victim Surcharge of £34 as well as £425 costs to Amber Valley Borough Council, totalling £709.
On handing down the sentence, the magistrate said: “You should have known better. You’ve been dealt with for this offence before and Amber Valley has tried to resolve this matter with you before it came to court.”
Cllr Trevor Ainsworth, chairman of Amber Valley Borough Council, said: “Keeping Amber Valley clean and pleasant for people is a key priority of the council.
“We know that the vast majority of people dispose of their waste in a responsible manner, using the refuse disposal sites or a reputable licensed waste carrier to remove larger items.
“Simply dumping waste in this way is both unnecessary and irresponsible and costs the taxpayer a significant amount of money.
“Once again, our enforcement officers have pursued a case to court to both discourage and bring to justice those who illegally deposit waste in our communities.”
Under the provisions of the Environmental Protection Act 1990, householders have a ‘duty of care’ to ensure that any waste they dispose of through a third-party contractor is handed only to a licensed waste carrier.
People can check online to see if a waste carrier is registered on the Environment Agency’s public register of waste carriers, using their registration number, business name, or postcode, or by phoning 03708 506506.
