Fly-tipping leads to conviction and £893 bill

A Langley Mill woman finally appeared in court on fly-tipping charges after a warrant was issued for her arrest, having failed to appear on three previous occasions.

Lalarnie Hayburn entered a guilty plea to a charge under The Environmental Protection Act 1990 of failing in her duty of care as an occupier of domestic premises to ensure disposal of waste is only to an authorised person. She was ordered to pay a fine of £140, costs of £723, £200 clear-up costs and a £30 victim surcharge – a total bill of £893.00.

Southern Derbyshire Magistrates heard Hayburn had paid a Richard Oakey of Ilkeston to take away her waste on three occasions. The waste was found fly-tipped.

Sue Bonnington, Community Support Principal Officer commented: “This incident was part of a much larger fly-tipping case where up to 10 other fly-tipping cases where reported. I would like to remind householders to be vigilant when disposing of household waste and not use so called ‘white van man’ to remove waste unless they are sure they are registered waste carriers.

“Most householders are unaware that if they pay these people to take their waste away at reduced costs that they usually end up being fly-tipped and causing a detrimental effect on that area and community. The householder has a duty of care to make sure their waste is disposed of properly and may be prosecuted even though they paid someone to take it away.

“The Council spends thousands of pounds each year cleaning up after fly-tipping incidents. This case shows how seriously the Courts and the Council considers such incidents and their effect on local communities.”
