Local man sentenced for Shipley Park fly-tipping
The anti-social outcomes of using un-licensed waste removal operators were again highlighted when Ilkeston man Michael Millen appeared before Derby Magistrates on 29 May.

Millen, of Wood Street, Ilkeston, was prosecuted by Amber Valley Borough Council for fly-tipping waste on the edge of Shipley Wood, Heanor. He pleaded guilty of illegally depositing waste, under the Environmental Protection Act, and was fined £160 for the offence, ordered to pay a victim surcharge of £30, costs of 385.50, and a compensation order in favour of Derbyshire County Council of £243.00 - a total of £818.50. Derbyshire County Council, as the owners of the land, paid for the initial clean-up cost.
In the wake of this latest successful prosecution, Amber Valley Borough Council is again warning the public not to use un-licensed waste removal men - the so called ‘white van man.’ These people often advertise on social media and offer to take away rubbish at low cost. This waste often ends up being dumped on local lanes and car parks of local amenities.
Councillor Chris Short, Amber Valley Borough Council’s portfolio holder for Environment, stated: “Amber Valley Council will investigate incidents of fly-tipping and where there is evidence we will take enforcement action, including prosecution wherever possible. Householders are reminded that they have a ‘duty of care’ under the Environmental Protection Act to ensure that their waste is disposed of correctly. Where they do not do so they can be prosecuted too.”
Many fly-tipping incidents are traced back to the householder, who has used a firm advertising on social media. Many of these firms are unlicensed waste carriers and cannot dispose of the waste legally, and so dump it illegally around the Borough. The clean-up cost then has to be paid by local Council Tax payers.
The Council asks residents to either take waste to the waste amenity site at Loscoe, or ensure they use a licensed waste carrier. A licensed waste carrier will be able to provide evidence that they are licenced and will issue a ‘waste disposal document’ before they leave.
